The Government has updated the economic sanctions applicable to breaches in the gas sector, establishing the new amounts that will apply from January 1, 2026. The measure affects both licensed transport and distribution companies and third-party non-providers, based on economic variations recorded in the industry. For third-party non-providers, the adjustment was determined by the evolution of the Wholesale Price Index (IPIM), with a 15.88% increase that sets the minimum fine at $126,013 and the maximum at $126,013,000. In the case of licensed companies and sub-distributors, the update was 21.60%, setting a penalty range from $154,861 to $154,861,000. The measure was communicated through Resolution 973/2025 of the National Gas Regulatory Entity (ENARGAS), published this Tuesday in the Official Gazette, which was processed by the Argentine News Agency. The regulation provides that, in cases of persistent non-compliance after a notice or for breaches with serious social impact, the fine amount for providers can be increased up to $774,605,000. The calculation for licensed companies considered the average monthly increase in tariffs for residential and general service users, within the framework of the current tariff review process. This semi-annual update is carried out in accordance with the regulator's powers to adjust the scales according to the economic variables of the regulated activity.
